Oh well...
ASUC Elections Council Publicity Coordinator Rebecca A. Simon is in violation of Article XI, Section 2 of the ASUC Constitution and Title IV, Article IV, Sections 4.1 and 4.2 of the ASUC By-Laws. As an ASUC official, Simon is bound by the ASUC constitution not to restrict free expression. This provision must be followed in the distribution of the Voter’s Guide as provided for in the ASUC By-laws.

On the morning of Friday, April 2, 2004 Simon e-mailed Matt Holohan a revised version of his senate candidate statement in which all instances of the word “fuck” were replaced with the letter-and-symbol sequence “f*ck.” Holohan did not authorize this editorial change, and this change is a blatant violation of Holohan’s rights to free expression as a senate candidate.

Simon has pursued a similar course of action with respect to the statement of candidate Dan Freeman.

Because Simon has arbitrarily set a deadline of 5:00 p.m. on April 2, 2004, for Voter’s Guide issues to be resolved, Holohan respectfully requests that he Judicial Council issue an PRELIMINARY INJUNCTION preventing Simon from going to press with the Voter’s Guide until these censorship issues have been properly resolved. If Simon is permitted to go to press with the unauthorized and censored statements, irreparable harm will result in that Holohan and other Squelch! Party candidates will be denied their opportunity to have their actual statements distributed in the Voter’s Guide.

In addition, Holohan respectfully requests that the Judicial Council issue a WRITE OF MANDAMUS ordering Simon to (1) print Holohan’s statement exactly as Holohan submitted it, (2) print Freeman’s statement exactly as Freeman submitted it, and (3) correct any other censorship whatsoever of any statements by any Squelch! Party candidates.
